Terms and Conditions.

General.

In this agreement unless the context otherwise requires "The Seller" shall mean 252 Spares, 32 Whitesands, Dumfries, DG1 3RS. "The Buyer" means the person or company buying the goods or services, "The Goods or service" shall mean all the items to be supplied and all the work to be done by the seller. Quotations do not constitute an offer by the seller to supply the goods. No modification of these terms and conditions can be made and will be binding upon the seller unless specifically accepted in writing by the seller.

Price.

The seller reserves the right to vary the quoted price, and goods will be invoiced to the buyer at th price ruling at the time of despatch unless otherwise agreed by the seller in writing. All prices quoted are inclusive of VAT at the current rate of 17.5%

Guarantee.

The Seller, will at its option, replace or credit the buyer with the value of the defective goods supplied by the seller. The seller will only do this if it is satisfied such defects arose solely through faulty material or workmanship, and such goods are returned in a manner agreed by the seller, immediately on discovery of the defect. The seller will normally not consider any claims made after 12 months from date of despatch. Where the goods are sold under a consumer transaction the statutory rights of the buyer are not affected.

Exclusion of Liability.

The conditions are in substitution for and exclude all and any express and implied statutory or other warranties, guarantees, representations conditioned and liabilities.

Delivery.

We will send your order straight away, you will normally recieve your order within 4 working days. We despatch goods Monday to Friday (excluding Bank Holidays). All goods must be checked before signing for reciept from carrier. Any deficiencies must be reported within 7 days of delivery in writing.

Force Majeure.

The seller shall not under any circumstances whatsoever be liable for any loss ariaing out of any cause whatsoever beyond the sellers control.

Descriptions.

The seller uses its reasonable endeavours to enbsure that the goods are accurately described by the seller and are fit for the purposes and applications stated on the seller's catalogues and website. The seller gives no warranty to this effect and accepts no responsibility for any loss or damage arising from errors or incorrect descriptions in the website or catalogues.

Right of Stoppage in Transit.

Goods are considered to be in transit from the time they are shipped by, or on behalf of the seller, until the buyer or their agent takes delivery of them. Where goods are in transit and the buyer becomes insolvent, the seller has the right to resume ownership of the goods, or by giving notice of their claim to the agent in actual control of the goods. When notice is given, the agent must re-deliver the goods to the buyer at the buyers expense.

Returning Goods.

Goods may be returned if unsuitable in original condition within 14 days. All the original packaging must be intact. The buyer must pay for postage costs on returned parts. A full refund will only be given where the seller has been at fault. If the buyer was at fault the refund will be subject to a 20% handling charge, and carriage costs of original invoice.

Data Protection.

252 Spares adheres to the Data Protection Act 1998. 252 Spares does not disclose customer information to third parties.

Payment.

Payment to be made at point of purchase through our secure Protx online direct debit system. Any refunds due will also be administered through Protx. View the Protx security policy.
